The website https://www.styleshifter.app and the Style Shifter plugin (the “Plugin”) are published by:

2. Scope

These Terms of Use (“Terms”) govern the use of the Plugin by end users (“Users”) when it is integrated into the product pages of participating fashion brands (the “Brand”).

The Plugin provides:

Virtual Try-On: Users may upload a photo to visualize how a garment might look on their body.
Size Recommendation: An indicative size suggestion generated automatically from that photo.

The Plugin is offered to Users free of charge by the Brand as part of their online shopping experience.

3. Relationship Between Style Shifter, the Brand, and the User

Style Shifter is a technology provider. We sell the Plugin as a SaaS solution to the Brand.

The Brand is responsible for its e-commerce website, its product sales, and its customer relationship with the User.

The User interacts with the Plugin only as a free tool embedded on the Brand’s website.

Accordingly:

Style Shifter is not the seller of products offered on the Brand’s website.
No consumer contract exists between Style Shifter and the User.
Any questions, claims, or disputes concerning the purchase of products must be addressed directly to the Brand.

4. Image Processing and Data Protection

Images uploaded by Users are processed solely to generate the try-on visualization and size recommendation.

The processing is automatic and temporary:

Images are not stored, saved, or retained after the result is displayed.
Neither Style Shifter nor the Brand has access to User’s image at any time.
Once processing is completed, the image is permanently discarded and cannot be retrieved.

GDPR Information

Because images are processed only ephemerally and never stored or accessible, Style Shifter and the Brand do not retain any personal data from this processing.

As no personal data are kept, requests to access, rectify, or erase your image cannot be applied after the session ends.

This processing is carried out in compliance with the principles of the General Data Protection Regulation (GDPR) and French law, with full respect for your privacy.

5. Accuracy and Limitations

Virtual try-on results are visual approximations and may not reflect exact fit, color, or fabric behavior.
Size recommendations are indicative only and do not guarantee the correct fit.
Users remain responsible for their final purchase decision.

6. Acceptable Use

Users agree not to:

Upload unlawful, offensive, or infringing content.
Misuse the Plugin in a way that disrupts its proper operation.

7. Intellectual Property

The Plugin, its technology, and related content are the exclusive property of Style Shifter.

Trademarks, logos, and product images remain the property of their respective owners.

8. Disclaimer and Limitation of Liability

The Plugin is provided “as is,” without warranty of uninterrupted or error-free operation.

To the maximum extent permitted by law, Style Shifter shall not be liable for any direct or indirect damages resulting from the use of the Plugin, including reliance on recommendations or visualizations.

9. Governing Law

These Terms are governed by French law. In the event of a translation, the French version shall prevail.

10. Changes to the Terms

Style Shifter may update these Terms from time to time. Continued use of the Plugin after an update constitutes acceptance of the revised Terms.
